FAQ: When can the IND withdraw the recognition of a sponsor?
The IND has adjusted all desks in such a way that the visit will be safe for both our clients and our employees. We have taken into account all current safety measures. This means that we are able to gradually schedule more appointments for providing biometrics and collecting residence permits (cards). The IND is handling the income requirements for highly skilled migrants and other employees flexibly if you rely on the temporary short-time working scheme (wtv). Read more on the page 'Coronavirus (COVID-19): effects on application or stay', under 'Employer, educational or research institution'.
The IND understands that the situation resulting from the coronavirus raises many questions for you. We are working hard to provide you with more information as soon as possible. Unfortunately, all planned information meetings are cancelled until further notice. This is due to the measures taken against the spread of the coronavirus. The February 2020 newsletter contained the article "New approach for passport photos from 1 January 2020". It announced that the employee (and family member) must now have a new passport photo taken at an IND desk or expat center for each new residence permit (card). The transition period that was also mentioned in that article has been extended until further notice. As long as the transition period applies, the IND will prepare a residence permit using an old passport photo that is already in our system where possible. Will the address of your organization's administration change? You are obliged to report this to the IND within 2 weeks. This can be done via the Business Portal or the written notification form that you can find on the page 'Legal obligations (recognised) sponsor labour related purposes'. Other address changes, such as the postal address or visiting address, can be reported using the written notification form. That way the right address will be in our system.
Are you unable to log in to the Business Portal, or do you encounter a technical malfunction after you have logged in? First, check whether there is a so-called notification bar on ind.nl. Maintenance or network outages are notified at the top of the website in this orange or red bar. No notification bar on ind.nl? Please report your log-in issue to the IND by e-mail. The IND regularly receives lists of recognised sponsors with the request to check whether the foreign nationals in question are employed by the organization concerned. These requests will not be processed. According to the obligation to keep records, an employer who is a recognised sponsor must know for whom he is a recognised sponsor.
The IND can withdraw recognition if the recognised sponsor no longer meets the conditions and/or obligations. This also applies if the recognised sponsor does not act as a sponsor for a foreign national and has not had a residence permit or mvv granted on behalf of a foreign national for over 3 years.
