Permanent asylum residence permit

You wish to continue to live permanently in the Netherlands. You can apply for a permanent residence permit. What are the conditions for this residence permit? And how does the application procedure work?

Conditions

  • You already have a temporary asylum residence permit for 5 years.
  • You still meet the conditions for a temporary asylum residence permit.
  • Do you have a temporary asylum residence permit as a family member travelling in connection with family reunification? The IND calls this a derived asylum permit. In that case there is the following condition: You have had a continuous stay of 5 years in the Netherlands before submitting your application for permanent stay. This means that you have not stayed outside the Netherlands for more than 6 months within these 5 years, or in total more than 10 months. Do you wish to apply for the residence permit as long-term resident EC? This is only possible if the family member you are staying with also has or has applied for the residence permit as long-term resident EC.
  • You are registered in the Municipal Personal Records Database (BRP) in your place of residence (municipality). You do not have to show this. The IND checks if you meet this condition.
  • You have a valid residence permit up and till the IND makes a decision on your application.
  • You have a civic integration diploma or you are exempt from having to take the civic integration exam.
  • Do you wish to get the residence permit as long-term resident EC? You must have a sufficient independent long-term  income.

This application costs € 159.

  • Children under 18 pay € 51.

Long-term resident EC

It is also possible to apply for a residence permit as long-term resident EC. You should then meet the conditions for a residence permit as long-term resident EC. You can also apply for the permit as a long-term resident EC when you already have a permanent residence permit.

Having a residence permit as a long-term resident EC allows you to apply more easily for a residence permit in one of the other EU countries that also have this residence permit. You do have to meet the conditions that that country has for a residence permit.

Steps in the application process

1. Submit application and payment

​You apply for the residence permit to the IND yourself. Use the application form. You can find the form at the bottom of this page. You send the application form together with the required documents to the IND by post. After the application has been received, the IND sends a letter stating how the fees are to be paid.

You must submit the application when your temporary asylum residence permit is still valid. Preferably 4 weeks before your residence document expires.

2. Receipt and check application

​After your application has been received, the IND sends an confirmation letter. The confirmation letter states the date the IND has received your application. It also states the period within which the IND makes a decision.

You can now go to the IND desk to give your biometric information. You do not have to make an appointment for this.

The IND will then check to see if your application is complete and that the fees have been paid. Are documents missing, or are documents not correct? In that case, the IND will send a letter: a request to rectify the omission. This letter lists the documents that you still needs to be sent. Send the requested documents before the mentioned date to the IND.

3. Decision

​The IND checks to see whether you meet all the conditions. The IND has to make a decision within a period of 6 months.

  1. The IND will first check if you meet the conditions for a permanent asylum residence permit.
  2. Do you not meet the conditions for a permanent stay? The IND will check to see if you meet the conditions to extend your temporary asylum residence permit. You do not have to submit a new application for this.

You will receive a decision on your application following this assessment.

  • Negative decision

    If you do not meet the conditions for a permanent stay, you will not get a residence permit. This decision is given in the form of a letter: the intended decision. The IND explains why you do not get a residence permit. Do you disagree with the decision? You then write a written response with an explanation to the IND. You must do this within 6 weeks. You can ask a lawyer to help you with this. You have to arrange this yourself.


    The IND will assess the content of your viewpoint. There are then 2 situations:
    • The IND rejects your application. This decision is given in the form of a letter: the formal decision. You do not get a temporary asylum residence permit. You will receive information about the possibility to appeal. The IND does extend the validity of your temporary asylum residence permit
    • The IND does not give you a permanent asylum residence permit. This decision is given in the form of a letter: the formal decision. The IND also informs you about your rights and obligations.
       
  • Positive decision

    When you meet all the conditions, you will get a permanent asylum residence permit. This decision is given in the form of a letter: the formal decision. The IND  also informs you about your rights and obligations. The IND will send you a letter to inform you when you can collect the residence permit.

Use this form for the extension of your residence permit asylum, to apply for a permanent residence permit asylum or to apply for a residence permit long term resident EC. This form is only available in Dutch.

How to send documents to the IND:

  • You only send copies of your documents, single-sided and on A4 paper.
  • The copies must be complete and legible.
  • Write down your V-number or client number on each copy. If you do not know these numbers, then please write your name and date of birth on each copy.
  • Do not send USB sticks, CDs or DVDs.
  • You keep the original documents yourself. You have to show these documents to the Dutch representation abroad.
  • Documents have to be translated to Dutch, English, French or German.

You do not have to pay for the application for extension of your temporary residence permit asylum.

After the application

Collect your residence permit

The IND aims to have your residence permit ready within 2 weeks following your arrival in the Netherlands. The IND will send you a letter indicating when you can collect the residence permit. You do not have to make an appointment to collect your residence permit.

Check to see if the information on the residence permit is correct while you are still at the IND desk. If something is incorrect, please inform the IND staff member at once.

Validity residence permit

A permanent residence permit has no end date. The residence document itself will always be issued for 5 years and can be renewed every 5 years. 

Right to work

The back of your residence permit shows if you are allowed to work. A permanent residence permit allows you to freely work in the Netherlands. Your employer does not have to have a TWV for you. Your residence permit states 'arbeid vrij toegestaan, TWV niet vereist' (work freely permitted, no work permit required).

Rights almost equal to Dutch citizens

Having a permanent residence document means you nearly have all the same rights as someone with Dutch nationality. The main differences are that you are not allowed to vote in national elections and you are not allowed to work in specific (Government) fields (such as the police, the army). You first have to apply for Dutch nationality for this. 

Legal obligations

There are a number of legal obligations you have to meet.

Is your residence permit damaged, lost or stolen? In that case, have the residence permit replaced.

Renew permanent residence permit

A permanent asylum residence document is always issued for 5 years. When it expires, you must apply for a renewal.

After having had a residence permit for a period of 5 years, you may apply for Dutch citizenship

TWV

​A TWV is a work permit. The employer applies for a TWV with UWV (Netherlands Employees Insurance Agency). UWV examines among other things if there is no employee with the Dutch, EU/EEA or Swiss nationality that is qualified for the job.
