How do I apply for review?

You can apply for review by sending an application for review to the IND. An application for review is a letter in which you explain why you do not agree with the decision. Apply for review within 4 weeks after the date of the decision. The postal address of the IND is stated on the letter containing the decision.

What do I need?

The application for review must contain the following information:

  • Your name and address.
  • The date.
  • The name and date of birth of the foreign national for whom you have applied for the residence permit.
  • The case number. This number is on the letter containing the decision.
  • A description of the points of the decision with which you do not agree.
  • The reasons why the decision is not correct, and evidence to support this.
  • Your signature.
  • A copy of the decision.

What does it cost?

Submitting an application for review is free of charge.

When will I receive a decision on my application for review?

Once the IND has received your application for review, you will receive an acknowledgment of receipt. This letter states how long the IND has to process your application for review. This is called the decision period. According to the law, the decision period for applying for review is 19 weeks.

May my partner stay in the Netherlands?

With the rejection of the application for a residence permit, your partner will receive a return decision. The return decision states by when your partner must leave the Netherlands. They will often receive an entry ban as well. The letter with the decision also states whether your partner may stay in the Netherlands during the application for review. In that case the return decision is postponed.

Request a residence endorsement sticker

Is your partner in the Netherlands? And allowed to stay in the Netherlands during the review, then your partner can request a sticker for their passport at the IND desk. With this sticker your partner can demonstrate that they may stay in the Netherlands during the application for review.

Apply for a provisional ruling at the court

Is your partner in the Netherlands? But not allowed to stay in the Netherlands? Then your partner can apply to the court for a provisional ruling. The judge will decide whether or not your partner may stay in the Netherlands during the application for review.

Your partner must leave the Netherlands

Is your partner in the Netherlands? And you have not applied for review of the negative decision? Or your partner is not allowed to stay in the Netherlands during the application for review? Then your partner must leave the Netherlands. If your partner does not leave the Netherlands on their own, they will be removed from the Netherlands.
