Previous residence permit
You can apply for a residence permit humanitarian non-temporary, if you had a residence permit for 1 of these residence purposes:
- Residence with a family member or relative
- Residence as a minor child with a child protection order
- Residence as a victim or witness of human trafficking
- Residence as a victim of domestic or honour-related violence
- Residence because you cannot leave the Netherlands through no fault of your own
- Residence for medical treatment

Requirements after residence with a family member

- There was no reason to withdraw your previous residence permit.
- You have fulfilled the civic integration requirement. This means you have passed the civic integration exam. This does not apply after residence with your parent as a minor child. Sometimes you do not have to fulfill the integration requirement. Requirements per family member
- You have had a residence permit for 5 years for one of these residence purposes:
- Residence with your spouse or partner
- Residence with your parent as an adult child
- Residence with your child as their parent
- Residence with another family member
- You have had a residence permit for 1 year for residence as a minor child, with your parent, adoptive parent or foster parent.
- You are a child born in the Netherlands, you have a residence permit for stay with parent, and your parent has a residence permit on non-temporary grounds.
- Your family member is a Dutch national or has a residence permit for a non-temporary purpose.
After death of family member
- You have or had a residence permit for residence with your spouse or partner. Or you have or had a residence permit for residence with your parent as a child.
- Your family member was a Dutch national or had a residence permit for a non-temporary purpose.
- You have not moved your main residence outside the Netherlands.
After residence with a family member with a European Blue Card
- You have had a residence permit continuously for 5 years for residence with your family member with a European Blue Card. This means the following is the case:
- during the past 2 years, you had a residence permit to stay with this family member in the Netherlands;
- before that, for at least 3 continuous years, you had a residence permit to live with this family member in another EU country.
Special individual circumstances after residence as a family member or relative
- You have or had a residence permit for residence as a family member or relative.
- You do not meet the other requirements that apply to the residence permit humanitarian non-temporary.
- Because of special and individual circumstances, you cannot return to your country of origin. This is the country of your nationality. Special and individual circumstances are, for example:
- The situation of (single) women in your country of origin.
- There is no good shelter for you in your country of origin.
- You have children who were born in or go to school in the Netherlands.
- You are a victim of violence within the family.
- The ties you have with the Netherlands.

Requirements after residence as a child with a child protection order
open minusYou meet these 3 requirements:
- You had a residence permit humanitarian temporary for at least 1 year. You received the residence permit under the policy that applies since 1 October 2019. The reason was that the court placed you under supervision.
- You are still under supervision.
- Your country of origin is still unable to take over the child protection order. This was made clear in the advice of the Repatriation and Departure Service (in Dutch: Dienst Terugkeer en Vertrek or DTenV).
Or you meet this requirement:
- You have had a residence permit humanitarian temporary for 3 years because you were under a child protection order.
Do you get the residence permit? Then the parents, minor brothers and sisters residing in the Netherlands can also apply for a residence permit.

Requirements after residence as a victim of domestic or honour-related violence
open minus- You have had a residence permit for 1 year as a victim of domestic or honour-related violence.
- The threat of domestic or honour-related violence still exists. Does the threat no longer exist? Sometimes you can get a residence permit humanitarian non-temporary because of your personal situation. The IND calls this urgent humanitarian reasons. The IND looks at these circumstances as a minimum:
- The situation of (single) women in your country of origin.
- There is no good shelter for you as a victim in your country of origin.
- You have children who were born in or go to school in the Netherlands.
- The use of violence within the family.
- The ties you have with the Netherlands.

Requirements after residence as a victim or witness reporting human trafficking
open minus- You have a residence permit because you are a victim of human trafficking.
- You have reported human trafficking. Or you have cooperated in the criminal investigation in a different way. One of these situations apply:
- The Public Prosecutor will proceed to prosecute the criminal offence. This means that the suspect will appear before court.
- The Public Prosecutor decided not to prosecute a criminal offense for human trafficking. You have filed a complaint with the court against this decision of the Public Prosecutor. Your complaint has been declared justified and the Public Prosecutor must now initiate criminal proceedings for human trafficking because of that. Please enclose a copy of the court decision, in which your complaint has been justified, with your application.
- The criminal investigation is still in progress. You have had the residence permit as a victim of human trafficking for at least 3 years.
- You have had a residence permit for 1 year as a victim of human trafficking who cannot or does not want to report this to the police. You cannot cooperate in the criminal investigation for one of these reasons:
- The same threat still exists.
- You still have a physical or mental illness.
- You are still a minor (under the age of 18).
Assessment of personal situation
Do you not meet one of these requirements? Or did you have a residence permit because you were a witness of human trafficking and reported this to the police? Because of your personal situation, you may be able to get a residence permit humanitarian non-temporary. The IND looks at reasons that have to do with human trafficking. For example one of these reasons:
- The risk of vengeance on you or your family. The IND checks whether the government in your country of origin is able or willing to protect you.
- The risk that you will be charged with an offence in your country of origin. For example with prostitution.
- The possibilities that you have in your country of origin to be included in society again.

Requirements after residence because it is not your fault that you cannot leave the Netherlands
open minus- You have had a residence permit humanitarian temporary for 3 years because you are not able to leave the Netherlands.
- You still meet the requirements for the residence permit humanitarian temporary.
- There are no other reasons to refuse the residence permit.

Conditions after residence for medical treatment
open minus- You have had a residence permit for medical treatment for at least 3 years. Or your departure has been postponed for 1 year under Section 64 of the Aliens Act (in Dutch: Vreemdelingenwet or VW). And immediately afterwards you had a residence permit for medical treatment for 2 years.
- Your medical treatment is necessary for at least 1 more year.
- During those 3 years there was no reason to withdraw your residence permit.
- You still meet the requirements for the residence permit medical treatment.
Other rules may apply for Turkish citizens and their family members.

• After residence with a family member and domestic or honour-related violence.
• After residence as a victim or witness of human trafficking.

If you apply online, you pay the costs (fees) immediately with IDEAL. Will you submit the application in writing? You will receive a letter that explains how you can pay.

We can extend the decision period if it takes longer to decide. For example, because the application is not complete. In that case, the IND will send you a letter.

- Positive decision: you will get an MVV and a residence permit.
- Negative decision: you will not receive an MVV and residence permit. You can object against this decision.

What else you need to know about the residence permit:
TB test
Did you indicate at the time of the application that you will take a TB (tuberculosis) test? Then make an appointment at the Public Health Service (in Dutch: Gemeenschappelijke Gezondheidsdienst or GGD). Do this within 3 months after you have received the residence permit. Take with you to the appointment:
Working with the residence permit
It says on the back of your residence permit whether you are allowed to work. With the residence permit humanitarian non-temporary, you are free to work in the Netherlands. It says on your residence permit ‘free to work. Work permit (TWV) not required’ (in Dutch: arbeid vrij toegestaan. TWV niet vereist). The shortening TWV stands for tewerkstellingsvergunning.
Legal obligations
You have an obligation to provide information. This means that you must notify the IND of changes in your situation. Find out more about your obligation to provide information.
The IND checks whether you meet your obligations. If you do not, you can get an administrative fine.
Validity period of the residence permit
The residence permit humanitarian non-temporary is valid for 5 years.
Type of residence permit
The residence permit is type I, temporary regular residence permit.
