Our start-up company participated in an accelerator programme last year. We would like to apply for a start-up permit for a third person at the same company. Is this possible?
Yes, that's possible. A non-EU or non-EEA citizen can apply for a start-up residence permit, even if the company in question has participated in an accelerator programme in the past. But this third person must still fulfil all requirements for the start-up permit. This includes having an agreement with a trustworthy and qualified facilitator.

Does the facilitator for a start-up have the same obligations as a sponsor (referent)?
No, the facilitator does not have the legal position of sponsor (referent). But the facilitator does have certain obligations. These are stated in the agreement that the facilitator and the applicant of the residence permit for start-up sign.

Do I have to show that I have sufficient income when I apply for the orientation year?
No, you do no need to provide proof of income when you apply for a residence permit orientation year. You will have to sustain yourself during the orientation year, but you do not have to show how. You will be allowed to work during your orientation year.
During the orientation year, you are not allowed to use public funds.

How can I see if I have a master’s degree on the basis of an Erasmus Mundus Masters Course or an Erasmus Mundus Joint Master (Degree)?
You will be awarded a joint degree or multiple degrees when you complete the Erasmus Mundus Masters Course, or an Erasmus Mundus Joint Master. These diplomas are issued by at least 2 participating higher education schools.

Can I apply for a residence permit for orientation year with a foreign bachelor's degree?
No, you cannot. When you have studied abroad, you should at least have obtained a master's degree.

In the last 3 years I have worked as a scientific researcher with a residence permit for highly skilled migrant. Can I apply for a residence permit for orientation year?
You can only apply for the orientation year if you have done scientific research at an educational institution or at a research institution funded or subsidized by the Dutch government.
Your letter of appointment or employment contract must state the job title and job code as drawn up in the University Job Classification System (Universitair Functieordeningssysteem (UFO) in Dutch). Your job code should start with 01.

What are the advantages of the orientation year?
With the orientation year you will have time to find a job as a highly skilled migrant in the Netherlands. During the orientation year you can work freely in the Netherlands. This means that your employer does not need a work permit for you. And your employer only has to pay at least the legal minimum wage (including holiday allowance). You can also use the orientation year to start your own business.
Did you find a job as a highly skilled migrant? In that case a reduced salary criterion applies to you. This makes it easier and less expensive for an employer to hire you. You keep the reduced salary criterion, also when you change employers. Read the requirements for a residence permit for highly skilled migrant.

I have found a job as a highly skilled migrant during the orientation year. Does my employer have to apply for a new residence permit for me immediately?
No, this is not necessary. You can work freely in the Netherlands during the orientation year. Your employer can wait until the end of your orientation year before he applies for a new residence permit. Do make sure that your employer applies before your residence permit for an orientation year ends. In this way, there will be no gap between your residence permits orientation year and highly skilled migrant. There will then also be no gap in your legal stay.

Can I work in other Schengen member states with a Dutch residence permit?
No, you cannot. A Dutch residence permit allows you to enter the Netherlands. It does not give you the right to work in other countries. If you want to work in another Schengen member state, you will have to apply for a residence permit and/or a work permit in that country.

Can my spouse, partner or minor child stay with me during the orientation year?
Yes, it is possible. You do have to meet all the requirements for the residence permits for Family and partner.
Requirement sufficient income
Do your family members already have a Dutch residence permit? In this case, you do not need to prove that you have sufficient income.
Do your family members not have a Dutch residence permit yet? In this case, you need to prove that you do have sufficient income. In the next 2 situations, you will meet the income requirements:
- You have a job that gives you and independent, sufficient and sustainable income.
- You have an amount in your bank account equal to 12 times the social assistance benefit (in Dutch: bijstandsnorm) including holiday allowance.
In both situations you and your family members are not allowed to apply for public funds.

How can I download or forward a confirmation if there is doubt about the delivery?
Current situation via Secure email starter (IND.nl):
Make a printout or screenshot of the confirmation. It is currently not possible to download the receipt (green envelope). The IND is looking into adding a download button for the delivery confirmation.
If you are using your own solution to email securely:
Contact your provider for information about downloading or forwarding the confirmation.

How do I add grounds to an objection letter?
You can do this in the same way the objection letter was submitted. See the instructions on Object or appeal decision.

What are the maximum file sizes for emailing?
- Maximum 10 MB per document.
- Maximum 20 MB per email.
Do you have larger files? Send them in multiple emails.

How do I report a longer period of absence, such as a notice of vacation?
You can report your absence to the IND via the Secure email starter on the page Submitting your documents. Always state if someone will be handling your cases in your absence. The notification will be linked to you as the authorised representative in the INDIGO system by the IND.
You can send a message to the IND in individual cases, for example, if you want to request an extension due to your absence. Refer to your earlier absence notification in that message.

Since 1 April 2025, faxing with the IND is no longer possible. Why has the IND stopped using fax?
- Faxes are technically outdated and vulnerable to interception.
- Fax communication does not comply with the General Data Protection Regulation (GDPR), NTA 7516 and BIO standards.
- Digital communication is more secure, and fits the digitalisation strategy of the IND.

How can I now contact the IND?

Do I always have to use Zivver?
Zivver is preferred because it meets all the technical requirements of NTA 7516. Other secure email applications are also allowed, if they can show they meet the NTA 7516 standards. The IND is currently assessing which applications are suitable. Once an application is approved, the IND can disable automatic replies (auto-replies).

Is the NTA 7516 certification still valid?
The NTA 7516 certification is no longer valid since 15 May 2022. However, the rules and agreements of NTA 7516 still apply. Organisations are still required to comply with them.

Can the IND give a list of approved email providers?
The IND has chosen to use Zivver because it meets all requirements. The IND is currently assessing which other email providers are also suitable. Check yourself whether your provider complies with NTA 7516.

How does secure emailing with the IND work?
Use a Secure email starter to email the IND easily and securely. The starter will direct you to the Zivver WebApp and send your email directly to the correct IND mailbox. Sending is almost always received (confirmation via the envelope icon).

How do I know if my email was received by the IND?
You will see a delivery confirmation via an envelope icon in the bottom left of your email:
- Green: Email successfully sent and received.
- Orange (upward arrow): Something went wrong. Click the envelope for more details.
No confirmation? Contact your email service provider.

What if I do not see a delivery confirmation?
Check the settings or subscription of your email application. Keep a copy of the sent email as proof.

My child has a residence permit to stay with parent and is going to study. Can my child live at another address while studying?
Yes, this is allowed if the child is a full-time student. Because a full-time student who does not live at home is still financially dependent on the parents. Therefore, the family relationship is not broken. And the residence permit to stay with parent remains valid.

In the ICT-Directive, what is meant by a group of undertakings?
A group of undertakings exist of two or more companies for which is recognised that according to national law they are linked. The companies are linked in one of the following ways:
- An undertaking holds a majority of the other undertaking's subscribed capital, directly or indirectly.
- An undertaking controls a majority of the votes attached to the other undertaking's issued share capital, directly or indirectly.
- An undertaking can appoint more than half of the members of that undertaking's administrative, management or supervisory body, directly or indirectly.
- The undertakings operate under the central supervision of the parent company.
This definition is differs from the definition of a group of undertakings in the Foreign Nationals Employment Act.

Does a network organisation fall within the scope of the ICT Directive?
In a network organisation the local partners are only linked through a set of agreements that each division needs to uphold. The local partners all own there own company. Neither of the parties in a cooperation possesses a majority of another partner organisation. Therefore, they are not part of a group of undertakings.

Do charity organisations or non-profit organisations fall within the scope of the ICT Directive?
If economic activities take place at a charity or non-profit organisation that organisation falls within the scope of the ICT Directive. All other conditions will have to be met as well.
The EU Court considers any activity that is to offer goods or services on a market as an economic activity.

What are the definitions of manager, specialist and trainee in the ICT Directive?
Manager:
An employee holding a senior position, who primarily directs the management of the concern (host entity), or a department or subdivision. The manager is receiving general supervision or guidance principally from the board of directors or shareholders of the business. Or equivalent persons. The position includes:- Directing the host entity or a department or subdivision of the host entity.
- Supervising and controlling work of the other supervisory, professional or managerial employees.
- Having the authority to recommend hiring or dismissing personnel. And authority in other matters of personnel policy.
Specialist:
A person possessing specialised knowledge essential to the host entity's areas of activity, techniques or management. This knowledge is assessed on two points:- The specific knowledge the host entity is looking for.
- Whether the employee has a high level of qualification for the type of work or activity. This includes adequate professional experience and possible membership of an accredited profession.
Trainee:
A person with a university degree who is transferred to a host entity for careerd development purposes or in order to obtain training in business techniques or methodes. The trainee is paid during the transfer. -
What is the difference between an apprentice and a trainee within the meaning of the Directive?
A trainee is already at least 3 months employed with the group of undertakings. There is no minimum term for apprentices. A trainee also must have a Master's degree from university. This does not apply to an apprentice.

What is the status of my application?
The IND does not provide information on the status of your application until a decision has been made. In most situations, a (statutory) decision period applies. The IND can make use of the entire decision period to process your application.

How can I get in touch with the person that is processing my application?
Do you need more information about your application, decision periods or letters sent by the IND? If so, we suggest you first try to find more information on our website. If you have any further questions, please call us at 0880 - 430 430 (normal charges apply, Monday to Friday from 9am to 5pm).
Have you received a letter from the person processing your application? If you have any questions, please contact them directly. For example, if you cannot provide us with the documents we have requested.
You will find the direct phone number of the employee concerned in our letter (under ‘Contactpersoon’).

Has the IND received my application?
Once you have submitted an application to the IND, you will receive a notification. You can track your application in My IND. When the IND has processed your application, you will see the status 'Received'.
An application submitted online is usually visible within a few minutes. Is your application not visible after a few minutes? Then do not call us immediately. After a maximum of 5 days, your application will be visible in My IND. A written application is registered in about 10 days.

I have lived in another EU country with my non-EU partner. I am a Dutch national. Can my partner apply for a EU residence document?
If you have lived in another EU Member State as a Dutch national, you have made use of the EU law on the free movement of people. You may therefore be seen as a community citizen. Your partner can apply for a residence permit as a family member of an EU citizen. Read more about the requirements on Dutch nationals and EU law.

My application has been rejected. Can I get a refund of the application fee?
No, this is not possible. The fee is paid for the review of the application.

What are the advantages of becoming a Dutch citizen?
- You no longer need a residence permit. Therefore, you no longer have to meet the requirements for a residence permit.
- You are included in the Personal Records Database (in Dutch: Basisregistratie Personen or BRP) of the Netherlands.
- You can apply for a Dutch passport.
- You can stay abroad for a longer period.
- You are allowed to vote in all Dutch elections.
- You are an EU citizen. You are allowed to vote in European elections.
- It will be easier for you to move to another EU country.
- You will be allowed to work in all public positions. For example as a mayor, police officer, soldier or judge.

Am I allowed to bring a second spouse to the Netherlands?
No, that is not allowed. In the Netherlands you are only allowed to be married to one person. That also means that only 1 spouse with his/her children is allowed to live with you in the Netherlands.

Can I bring my adult child to the Netherlands?
It is not possible to bring a child who has reached the age of majority to the Netherlands. Unless there are exceptional circumstances. For more information, contact the IND.

I’m going to study in the Netherlands. Can my partner also come?
This is allowed if you and your partner meet the requirements for a residence permit for partner.

Can I transfer to another educational institution during my studies?
Yes, but the new educational institution must be recognized as a sponsor. The new educational institution also has to notify the IND of your transfer. You do not need to apply for a new residence permit.

I have graduated. Can I stay in the Netherlands?
If you wish to stay in the Netherlands after your studies, you have to apply for a new residence permit. As a graduate you can make use of the orientation year for graduates. With your permit for the orientation year you have one year to find work in the Netherlands, for example as a highly skilled migrant.
Have you graduated? Your residence permit for study purposes will remain valid until 3 months after you deregister from your educational institution.
You can also apply for a start-up residence permit. This gives you one year to start an innovative company.
Do you have the possibility to do scientific research? Your employer or research institute can apply for a residence permit for you as a researcher highly skilled migrant, or as a researcher under directive (EU) 2016/801.

What is the difference between a residence permit for research (Directive (EU) 2016/801) and a residence permit as researcher (highly skilled migrant)?
A researcher that wants to apply for a residence permit highly skilled migrant, needs to have an employment contract (or appointment decision). A researcher based on the Directive (EU) 2016/801 only needs a hosting agreement.

Can I work with an expired permanent residence permit?
A permanent residence permit or long-term resident EU permit does not expire. Has your permanent residence card or long-term resident EU document expired? You are still allowed to work. However, you can apply for renewal of your residence document.

What is a sponsorship declaration? And what does signing it mean for me?
By signing a sponsorship declaration, you guarantee the costs of a foreigner's stay/residence in the Netherlands. You also guarantee that this foreigner leaves the Netherlands on time. The sponsorship declaration tells you exactly what your obligations are.

How long is my signed proof of sponsorship/accommodation valid for?
There is no legally set period of validity regarding the legalization of the 'Proof of Sponsorship/Accommodation'. The embassies and consulates use different periods of validity. For the latest information, contact the embassy or consulate. In the case of a possible objection, you will not need to have the form legalized again.

Can I sponsor more than one person?
It is possible to sponsor up to 2 adults plus 1 or 2 children at a time. You do have to use a separate form 'proof of sponsorship/accommodation' for each person. You must also have a legalisation of your signature on each form. The Dutch representation abroad (embassy or consulate), or the Consular Service Organisation (CSO) determines if you can sponsor multiple persons and how many.

I'm listed in the Personal Records Database (BRP) with nationality Unkown. Do I have to renounce my nationality?
When you applied for a residence permit, you stated your nationality. You received your residence permit with this nationality. If you want to apply for Dutch citizenship, you must renounce your nationality. Different rules apply to a person who is stateless.

My application for naturalisation is still pending. Am I allowed to move abroad?
This depends on your situation. In most cases, you must continue living in the Netherlands until your naturalisation is completed. This means until after the naturalisation ceremony. During this entire period, you must have a valid residence permit or the right of residence under EU law.
Married to a Dutch national
Do you live with your Dutch partner and are you married or registered partners? Then nothing changes for your application for naturalisation if you move to another country together. However, you are not allowed to move to a country of which you currently have the nationality. And you must continue living together as married or registered partners until your naturalisation is complete.
Living together without being married
Do you live together without being married? Then the IND may reject your application if you move abroad. This is because, as unmarried partners, you must continue to live in the Netherlands until your naturalisation is complete.

Why can I not log in with my DigiD?
Is there any maintenance or malfunction with DigiD?
DigiD is not part of the IND. Check with Logius (Dutch only) if there is maintenance or a malfunction with DigiD.
Is there no maintenance or malfunction with DigiD, but you are unable to log in?
This may have a number of causes:
- You are not using the correct username or password. Check that you are using the correct details. Pay attention to the use of upper and lower case letters.
- You have not activated your DigiD. First activate your DigiD with the activation code you received by letter.
- Your DigiD is blocked. Wait until the blockage is lifted and try again.
- Your DigiD has expired because you have not used it for 3 years. If so, reapply for your DigiD.
Are you using old software on your computer or mobile device? It may not meet DigiD's minimum security requirements.
