Staying in the Netherlands if your situation with the EU citizen has changed

Under EU law you had the right of residence in the Netherlands because you lived with a family member or partner from the EU, EEA or Switzerland. Has your situation changed? For example because your family member or partner died or your relationship has ended. Find out if you are allowed to continue to live in the Netherlands.

Situations in which you may continue to live in the Netherlands

Do you no longer have the right of residence with your family member or partner from the EU, EEA or Switzerland? Then you can stay in the Netherlands in some situations. From now on, we will call your family member or partner a citizen of the Union.

You have EU, EEA or Swiss nationality

Then you can continue to live in the Netherlands. However, there are requirements. Find out what the requirements are on the page Living in the Netherlands as an EU, EEA or Swiss citizen.

You have another nationality

You have another nationality and no longer have the right of residence with the citizen of the Union. Select your situation below and find out whether you can continue to stay in the Netherlands. Is the citizen of the Union a Dutch national? Then the situations only apply to you if you have a residence document Familie EU/EER to stay with a Dutch national to whom EU law applies.

Your income is high enough (income requirement)

You must have enough income to be allowed to continue to live in the Netherlands. We call this the income requirement. For the income requirement, it does not matter which nationality you have.

In these situations, your income is high enough:

  • You are an employee or entrepreneur. You carry out genuine and effective work. This means that you work at least 40% of the regular full working week. Or you earn at least 50% of the social assistance benefit applicable to you.
  • You have an income that is the same or higher than the standard amount applicable to your family situation. And you have health insurance in the Netherlands.

No income requirement

In the following situations the income requirement does not apply:

  • You are the child of an Union citizen that died or has left the Netherlands. And you study in the Netherlands.
  • You are the caretaking parent of a child of an Union citizen that died or has left the Netherlands. And the child studies in the Netherlands.

Apply for a new residence document

Do you no longer have right of residence with the citizen of the Union and are you allowed to continue to live in the Netherlands? Then you sometimes need a new residence document. Look at the following situations and check whether you must apply for a new residence document:

  • Your residence document is still valid. You will keep this document and do not need to apply for a new one. However, you must notify the IND that the situation has changed. 
  • Your residence document is no longer valid. And you do not have permanent residency yet. You must apply for a new residence document. You will find the application form on this page under Application forms.
  • You have been living in the Netherlands continuously for 5 years. You may have permanent residency. You must apply for a new residence document. Find out more on the page Permanent residence permit for Union citizens and their family.
