IND informs third-country nationals from Ukraine about right of residence
From 6 May, third-country nationals with a temporary residence permit in Ukraine can pick up a residence sticker. With this sticker, they can demonstrate that they can stay and work in the Netherlands for the time being. This is written in a letter that the IND will send to around 1900 third-country nationals today. Next week, the lawyers of these third-country nationals will also receive a copy of the letter.
The return decisions taken earlier by the IND have been suspended until 4 March 2025 at the latest.
Longer use of rights
The letter follows the decision by the Minister for Migration (only in Diutch)on 25 April 2024 to freeze the consequences of the termination of temporary protection for this group. Because of this, third-country nationals with a temporary residence permit in Ukraine can make longer use of the rights they had under the Temporary Protection Directive (TPD). The freezing and thereby the rights of the TPD will apply until 4 March 2025 at the latest, or earlier if the Court of Justice of the European Union (EU court) issues a judgment before this date.
Unclear how long consequences remain frozen
Until when the third-country nationals are allowed to stay is still unclear. This is because the Minister is waiting for a ruling by the EU court. On 25 April 2024, the Council of State requested a preliminary ruling from the EU court on the interpretation of the TPD. And on the termination of temporary protection for this group of third-country nationals.
