Residence permit article 8 ECHR private life

Article 8 of the European Convention on Human Rights (Article 8 ECHR) protects the right to private life. In rare situations, you may be granted a residence permit in the Netherlands under Article 8 ECHR. But this almost never happens.

Why you almost never get a residence permit under Article 8 ECHR?

The IND only gives this type of residence permit in rare situations. For example, you must have lived in the Netherlands for a long time and must have a strong connection with the Netherlands. There should also be very special reasons why you cannot or do not want to leave the Netherlands. You also do not meet the requirements for any other type of residence permit. This means that there is a very high chance that the IND will reject your application.

Interests of the Netherlands carry significant weight

The Netherlands protects its general interests, such as national security, public order and economic well-being. Only in rare situations do your personal interests outweigh these, giving you the right to live in the Netherlands.

A residence permit based on your right to private life under Article 8 ECHR has a non-temporary humanitarian residence purpose.
