Temporary Protection Directive for Ukraine extended, with new condition for new applications
The European Union has extended the Temporary Protection Directive (TPD) for displaced persons from Ukraine until 4 March 2028. At the same time, a new condition applies to new applications as of 5 August 2026. In principle, individuals who have military obligations in Ukraine are only eligible for temporary protection if they can demonstrate that they have fulfilled their military obligations or are exempt from them.
Extension until 4 March 2028
Displaced persons from Ukraine who already held temporary protection in the European Union before 5 August 2026 retain their temporary protection until 4 March 2028. This means they also keep their right to reside and work in the Netherlands and to access services such as accommodation, education, and medical care. The extension is automatic; no action is required on their part.
New condition for new applications
For new applications submitted on or after 5 August 2026, individuals subject to military conscription in Ukraine must demonstrate that they have fulfilled their military obligations or are exempt from them. They can demonstrate this, for example, using documents from the Ukrainian authorities. This new condition does not apply to people who already held temporary protection in the European Union before 5 August 2026. Nor does the restriction apply to individuals joining family members who already have temporary protection under the TPD.
