Third country-nationals with a temporary residence permit in Ukraine can no longer make use of the rights associated with temporary protection from 4 September 2025. Next week, around 1,000 third-country nationals will receive a letter explaining this decision.
Third-country nationals are people from outside the EU who stayed in Ukraine temporarily. It concerns, for example, people with a student visa who fled to the Netherlands together with Ukrainians after the outbreak of the war.
A freeze measure has applied to this group since April last year, as it was unclear whether their temporary protection could be ended. Due to the measurement, the group has remained entitled to municipal reception, facilities and work.
A recent ruling by the Council of State confirms that the temporary protection for this group of third-country nationals was allowed to be ended and is thus in line with a previous ruling by the European Court of Justice.
The ending of the freeze measurement means that these people must leave the Netherlands within 4 weeks from 4 September. Unless they have a residence permit, a pending asylum procedure or have applied for a regular residence permit before 4 September. People that previously objected to the return decision are allowed to await the ruling on their appeal in the Netherlands. Meanwhile, they may continue to make use of the rights associated with temporary protection, even after 4 September.
