Applying for a residence permit as a foreign investor is no longer possible

Since 17 April 2024, it is no longer possible to apply for residence as a wealthy foreign national. This is because the admission regulation for foreign investors has been abolished.

Why has this regulation been abolished?

The regulation existed since 1 October 2013 and has barely been used. The regulation is no longer in effect because:

  • The small contribution of the regulation to the business climate and to the financing of startups in the Netherlands;
  • It has not been possible to make the scheme more attractive without increasing the risk of abuse.

It has therefore been decided to discontinue the regulation as of 17 April 2024. However, it remains possible to extend an existing residence permit. The investor must then meet the requirements that applied before the regulation was abolished.

Changes to the requirements for a residence permit for transfer within a company

On 16 April 2024, the requirements for a residence permit for intra-corporate transferees were changed.
The change means that the employee must stay outside the EU for a period of 6 months when:

  • The employee was a manager or specialist and the previous transfer reached the maximum duration of 3 years;
  • The employee was a trainee and the previous transfer has reached the maximum duration of 1 year.

Previous residence in another EU country is taken into account when determining the maximum period. The change is stated in Article 3.30d, paragraph 2, Aliens Decree (in Dutch: vreemdelingenbesluit or Vb). The article is only in Dutch.

Cooperating Service closed on May 23 and June 25 in the morning

This year the Cooperating Service will be closed on a number of days between 9:00 and 13:00. In the upcoming period, this applies to the following days:

  • Thursday 23 May
  • Tuesday 25 June

Waiting times in the afternoon may be longer than usual on these days. Therefore, preferably call the next day or later in the week. Thank you for your cooperation.

Notification form for change of recognised sponsor of highly skilled migrant not necessary for simultaneous application for extension

Are you hiring a highly skilled migrant who previously worked for another recognised sponsor? And does the highly skilled migrant's residence permit expire at the same time? Then it is sufficient that you, as a new recognised sponsor, apply for an extension for the highly skilled migrant. You do not need to send a notification form to the IND to report the change of recognised sponsor. By applying for extension of the residence permit, you already meet the information obligation. You can apply for the extension a maximum of 3 months before the expiry of the residence permit.
